These Terms & Conditions (“Terms”) govern your use of cooleralert.com (the “Site”), operated by Cooler Alert (“we,” “us” or “our”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

These Terms cover the website only. If you buy or subscribe to the Cooler Alert monitoring service, that service is also governed by any order terms or service agreement we provide to you, and those terms control if they conflict with these.

1. Using the Site

You may use the Site for lawful purposes, such as learning about our products and contacting us. You agree not to:

  • Use the Site in a way that violates any law or regulation
  • Try to gain unauthorized access to the Site, its servers or its data
  • Interfere with the Site’s operation, including by sending spam, malware or excessive automated requests
  • Copy or scrape Site content in bulk
  • Submit false information or impersonate another person or business in our forms

2. Information on the Site Is General Information

We work to keep the Site accurate and current, but its content is provided for general information only.

  • Compliance information: our pages about FDA, FSMA, HACCP, CDC, USP, USDA, AABB and EPA requirements summarize those rules in general terms. They aren’t legal or regulatory advice, and regulations change. You’re responsible for confirming which requirements apply to your operation and for meeting them.
  • Savings and ROI estimates: figures such as labor costs, spoilage losses and return on investment are estimates based on industry averages. Your actual results depend on your labor costs, inventory value, equipment condition and other factors.
  • Testimonials: customer stories reflect those customers’ own experiences and aren’t a guarantee that you’ll get the same results.
  • Prices and product details: prices, packages and features shown on the Site may change without notice, and we may correct errors, including pricing errors.

3. Forms

When you submit a form on the Site, you agree to give accurate information and allow us to contact you about your request. Our Privacy Policy explains how we handle the information you send us.

4. Intellectual Property

The Site’s content, including its text, graphics, logos, photos, videos and design, belongs to Cooler Alert or its licensors and is protected by copyright and trademark law. You may view and print pages for your own business reference. You may not copy, modify, republish or distribute Site content without our written permission. Customer names and logos shown on the Site are the property of their respective owners.

5. Third-Party Links and Services

The Site links to or embeds services run by others, such as Google Calendar for scheduling, Google Maps for directions and our Google reviews. We don’t control those services and aren’t responsible for their content, availability or privacy practices. Your use of them is subject to their own terms.

6. Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, express or implied, about the Site or its content, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t guarantee that the Site will be uninterrupted, error-free or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Cooler Alert and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or inventory, arising from your use of the Site, your inability to use it, or your reliance on its content. Nothing in these Terms limits any liability that cannot be limited under applicable law.

8. Indemnity

You agree to indemnify and hold harmless Cooler Alert and its owners, employees and partners from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute about the Site or these Terms will be resolved in the state or federal courts located in Virginia, and you agree to the jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.
